[draft:]

It appears to me that yr difficty wd be met by a provisn enablg y. t throw up the lease at months notice.

Another reason why it wd be advants if smeltg fnaces shd be erected, is, that the ferrigs earth wd all come into use.

As you say, it is uncomfortble (tho’ ^sometimes necessary sometimes however) to haggle about pennies.

provided that it the ore be sold to be ^all ore sold for ye ppose ^of being smelted within miles (say 10 miles? of the pits, the royalty so in Wiltshire to be excepted fm this agreemt rule & to be made ye subjt of a septe agreemt, the royalty on ^all such ore to be 1/6

If it shd be found desirable hereafter for the lessee to convey down to the canal on his tramway railway the ore belongg to any other proprietor, such the prevs consent in writing of Mr T. the lessor shall be requisite & it shall form ye subject of a septe agreemt

An agricl rent of 2£ per acre

I thk my calcns are correct – I mean, as to the large consid profit wch (ye lessee wd get)

I ∴ am not prepar’d to accept yr offer in its prest shape. ^Besides I look to the future a little, ^to the time when the Bristol & S. Wales Rlwy will be opened, & wch will be a further advantage of 1/6 per ton – to the lessees by shortening the distance length of the railway carriage

Whatever profit the lessee ^may make s at present, will be increased 1/0 or 1/6 pr ton, by the opening of that railway & the conseqt shortening of the distce to Wales.

[expanded version:]

It appears to me that your difficulty would be met by a provision enabling you to throw up the lease at months notice.

Another reason why it would be advantageous if smelting furnaces be erected, is, that the ferriganaceous earth would all come into use.

As you say, it is uncomfortable (though sometimes necessary sometimes however) to haggle about pennies.

provided that it the ore be sold to be all ore sold for the purpose of being smelted within miles (say ten miles of the pits, the royalty so in Wiltshire to be excepted from this agreement rule and to be made the subject of a seperate agreement, the royalty on all such ore to be one-sixth.

If it should be found desirable hereafter for the lessee to convey down to the canal on his tramway railway the ore belonging to any other proprietor, such the previous consent in writing of Mr Talbot the lessor shall be requisite and it shall form the subject of a separate agreement.

An agricultural rent of 2£ per acre

I think my calculations are correct – I mean, as to the large profit which (the lessee would get) consider

I therefore am not prepared to accept your offer in its present shape. Besides I look to the future a little, to the time when the Bristol & South Wales Railway will be opened, and which will be a further advantage of one shilling six pence per ton – to the lessees by shortening the distance length of the railway carriage Whatever profit the lessee may makes at present, will be increased one shilling or one shilling six pence per ton, by the opening of that railway & the conseqeuent shortening of the distance to Wales.

Notes:

1. This was a common way to test the nib.
