Ye lang. of Ye paper you sent was too techl. If you look at my note of Janry 2d you will see that I wished for a document not in technical language

Instead thereof, please to send Mr Freeman ye enclosed, & enquire if these terms are understood ^to be agreed to?

If so ye license shall be prepared in accordance with them.

Mr F. to have licse to use ye Ctype process within ye Cty of Somerset & ye city of Bristol and 5 miles around it. not to sell ports below 10/ each

Not to sell any Ctype picture for [illegible deletion x 2] or other pi

^copies of portrts copies of portrts views, or other represns of objects ^ whatever made by this process below ye price of 5/ each

To pay as patt dues 25 per Ct on ye actual selling price of ye pictures portraits, copies, &c.

With respect to frames of pictures

to keep accurate accs

not to part with ye negative, or original Calotypes.

not to sell or part with, ye iodized or Calotype prepared paper

To put his initials ^& a no on all [illegible deletion] ye pictures sold each Ctype sold

Not to publish any work with Calotype photographic plates without consent of Mr T <2>.

^Before receiving instructions in ye art to deposit with Mr Awdry <3> 50 £ as an Earnest of intention to continue. This sum to be taken as Also a sum of 10 £, which is to be paid to Mr Henneman <4> of Reading, for his trouble in giving the instructn

^But If no instructns are required by Mr F. these deposits will not be required.

Besides ye usual agreements as to keeping proper accounts, &c.

Shd Mr F. make very little use of this Lce he agrees to give it up again. Namely in case if he does not take a certain no of ports per Ann

It is left for further considn what that ^smallest no ought to be.

Mr. Freeman to have license to use the Calotype process within the County of Somerset and the city of Bristol and 5 miles around it not to sell portraits below 10 shillings each

Not to sell any Calotypetype picture for [two illegible deletions] or other picture

copies of portraits copies of portraits views, or other representatioins of objects whatever made by this process below the price of 5 shillings each

To pay as patent dues 25 per Cent on the actual selling price of the pictures portraits, copies, &c.

With respect to frames of pictures

to keep accurate accounts

not to part with the negative, or original Calotypes.

not to sell or part with, the iodized or Calotype prepared paper

To put his initials and a number on all [illegible deletion] the pictures sold each Calotypetype sold

Not to publish any work with Calotype photographic plates without consent of Mr. Talbot

Before receiving instructions in the art to deposit with Mr. Awdry fifty pounds as an Earnest of intention to continue. This sum to be taken as Also a sum of 10 pounds, which is to be paid to Mr. Henneman of Reading, for his trouble in giving the instruction.

But if no instructions are required by Mr. Freeman these deposits will not be required.

Besides the usual agreements as to keeping proper accounts, etc.

Should Mr. Freeman make very little use of this License he agrees to give it up again. Namely in case if he does not take a certain number of portraits per Annum.

It is left for further consideration what that smallest number ought to be.

1. On 17 December 1843 James Freeman of Brock St., Bath, wrote to West Awdry (1807–1892), solicitor, Chippenham, requesting a license for Somerset. Lacock Abbey Collection, Wilts Record Office. Freeman (1814-1870), Daguerreotypist for Richard Beard in Bath; possible calotypist in Bath and later claimed to have worked for WHFT; from 1853, partner in Freeman Studios in Sydney, Australia; died during a visit to Wales.
